It should be noted that simply because a component is subject to California Proposition 65 does not mean that a warning for the finished product is required. The warning requirements are dependent on the anticipated level of exposure to the restricted components resulting from foreseeable uses of a product. The warning requirements will only apply if the foreseeable and intended uses of a product containing these materials are likely to result in exposures above what are referred to as “significant risk” or “observable effect” levels. A determination of “significant risk” or “observable effect” can only be made with full knowledge of the end uses and applications of the products. Westlake Plastics Company does not control or have complete knowledge of the end uses to which the customers put the materials. Therefore, the decision to include or not include a warning must ultimately rest with Westlake Plastics Company’s customers.

Carbon black and titanium dioxide are listed on the Proposition 65 list as “airborne, unbound particles of respirable dust”. The carbon black and titanium dioxide present in our products are bound within the polymer matrix. However, machining of Westlake Plastics Company’s products might produce respirable dust.
